This Privacy Policy explains how Viva Vitality MN ("Viva Vitality," "we," "us," or "our") collects, uses, and protects your information, and describes your rights regarding that information when you use our website, vivavitalitymn.com, or engage our services.

At https://www.vivavitalitymn.com, operated by Revive MD PLLC, doing business as Viva Vitality, we prioritize your privacy and are committed to safeguarding the information you share with us. This document describes how we handle the Personal Information collected through our website, applications, and services (collectively, "Services").

If you have questions or concerns about this policy, please contact us.

1. Collection of Personal Information

When you visit our website or use our Services, we may collect the following:

Directly from You. When you create an account, use our Services, or communicate with us, we collect:

  • Account Information: your name, contact details, account credentials, payment information, and transaction history.
  • Content: Personal Information contained in your inputs, uploads, or feedback to our Services.
  • Communication Information: if you contact us, your name, contact details, and the content of your message — including your mobile number and consent status if you opt in to text messaging.
  • Social Media Information: interacting with our social media accounts may result in our collection of your contact details. Social media platforms may also provide us with aggregated user-interaction data.

Automatically Collected Information. As you navigate and interact with our Services, we collect:

  • Technical Information: browser and device data, IP addresses, usage patterns, and cookies, used to improve your experience and our Services.

2. Use of Personal Information

We use your Personal Information to:

  • Deliver and improve our Services.
  • Communicate with you about your care, appointments, and our offerings.
  • Conduct research and prevent fraud.
  • Comply with legal obligations and protect our rights.

3. Disclosure of Personal Information

We may share your Personal Information with:

  • Service Providers: vendors who support our business operations and service delivery (for example, scheduling, payment processing, and IT hosting) under confidentiality obligations.
  • In Connection with Business Transfers: as part of a merger, acquisition, financing, or similar business transition.
  • For Legal Reasons: when necessary to comply with applicable law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Viva Vitality, our patients, or others.

We do not sell Personal Information, and — as described in Section 3a below — we do not share mobile phone numbers or SMS consent with third parties for marketing or promotional purposes.

3a. Text Messaging (SMS) Privacy

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We collect mobile numbers and SMS consent only from patients and prospective patients who opt in directly, whether in person, by phone, or through a form on our website. Information shared with the service providers who help us deliver text messages is used solely to send messages on our behalf and is subject to confidentiality obligations.

You can opt out of text messages at any time by replying STOP, or reply HELP for assistance. Message and data rates may apply, and message frequency may vary.

For the full terms governing our texting program, see our SMS Terms and Conditions.

Website Tracking, Advertising and Analytics

This section explains the tools our website uses to understand how it is used and to measure our advertising. It applies to visitors to vivavitalitymn.com and its landing pages.

What we use. Our website uses Google Analytics and Google Ads measurement tags and, on our public informational pages, the Meta (Facebook and Instagram) Pixel. These tools use cookies and similar technologies and may collect your IP address, browser and device information, the pages you view, and how you arrived at our site (for example, the ad you clicked).

What we do not send to advertising and analytics companies. We do not send your name, email address, phone number, or any answers you give on our eligibility questionnaire to Google or Meta. Our eligibility questionnaire, checkout, and order-confirmation pages do not run the Meta Pixel. We have turned off the Meta feature that automatically matches details entered in website forms to Meta accounts.

Advertising measurement. When you click our Google ad, we record that the qualification button was clicked and, if you complete a purchase, that a purchase occurred and its dollar amount. This information does not include your name, contact details, or health information. We have turned off Google's advertising personalization for this measurement.

Advertising and retargeting. We do not build advertising audiences based on health conditions, symptoms, treatments, questionnaire answers, or eligibility results, and we do not upload patient or customer lists to Google or Meta. We may show general advertisements about Viva Vitality to people who visited our public informational pages or who engaged with our social media accounts. Our advertisements are not written to suggest that you have a medical condition.

Analytics retention. We have turned off Google signals and set Google Analytics to keep detailed user and event data for two months.

Information you give us directly. Contact details and eligibility answers you submit are sent only to our own systems and to service providers that support our clinic operations under confidentiality obligations: our customer-management and communications platform (GoHighLevel), our payment processor (Stripe), and our patient-intake platform (IntakeQ). We use this information to assess whether our program may be appropriate for you, to contact you, to process payment, and to arrange lab work. Information collected in the course of providing clinical care is protected as described in the HIPAA section below.

Your choices. You can block or delete cookies in your browser settings; use Google's tools at adssettings.google.com and tools.google.com/dlpage/gaoptout; adjust your ad settings at facebook.com/adpreferences; or opt out of interest-based advertising at optout.aboutads.info. Blocking cookies may affect how some pages work.

Minnesota and other state residents. Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal data, to opt out of targeted advertising, the sale of personal data, and profiling, and to ask which third parties receive your data. We do not sell personal data. To make a request, email info@vivavitalitymn.com. We will respond within the time required by law.
